Mountain City VR Adventures Liability Waiver
Acknowledgment of Risks
By participating in any virtual reality escape room activities at Mountain City VR Adventures (“MCVRA”), you acknowledge that there are inherent risks involved in these activities that cannot be avoided even with reasonable care and caution. For example, wearing the VR headset obscures your vision and may lead to tripping, stumbling, or colliding with walls, furniture, or other participants. The immersive audio-visual experience may also induce temporary disorientation, nausea, dizziness, eye strain, or headache. Repetitive motions with handheld controllers may cause wrist or shoulder discomfort. In rare cases, intense sensory immersion might trigger a startle response or unanticipated physical reaction. While we take reasonable precautions to provide a safe experience, including clearly marked play boundaries, safety briefings, and staff supervision, it is impossible to eliminate all potential hazards. By agreeing to participate, you confirm that you understand and accept that unforeseen events or accidents may occur.
Assumption of Risk; Promise Not To Sue Us
To the maximum extent permitted under applicable law, you voluntarily assume all risks, both known and unknown, associated with your participation in our VR escape room experiences. This means that, to the maximum extent permitted by the law of the jurisdiction in which the MCVRA site you visit is located, you accept responsibility for any harm, injury, loss, damage, or discomfort (“Harm”) that you may experience during or as a result of taking part in the activity, regardless of the cause. You also promise, the maximum extent permitted under applicable law, that neither you nor anyone acting through you or seeking to vindicate your legal rights will sue or otherwise initiate legal action against MCVRA for any Harm arising out of or relating to your visit to our site or participation in an activity there.
Waiver of Liability
By signing this waiver, you agree, on behalf of yourself and anyone acting through you or seeking to vindicate legal rights relating to you or your visit to a MCVRA location, to release and to hold harmless MCVRA, its owners, employees, and agents, from and against any and all liability, claims, demands, or causes of action (“Claims”) arising out of or relating to your participation in any activities at a MCVRA site to the maximum extent permitted by applicable law. This release includes, but is not limited to, any claims alleging negligence on the part of Mountain City VR Adventures or its staff. In other words, you are giving up your right to sue us for any injury or damage you might sustain in connection with your visit, except in cases of gross negligence, fraud, or other willful misconduct.
Damage Responsibility
You agree to be financially responsible for any damage that you or companions for whom you are responsible (such as all minors) may cause to our facilities, VR equipment, or other property due to negligent, reckless, or willful actions. If equipment or property is damaged because of misuse or failure to follow instructions, you agree, promptly upon our request, to pay for the repair or replacement of those items.
Guardian Consent for Minors
If the participant is a minor (under 18 years of age), a parent or legal guardian must sign this waiver on the minor’s behalf. By signing as a guardian, you confirm that you have the authority to do so, and you agree to all the above terms on behalf of the minor. You also agree to ensure that the minor follows all rules and instructions during the MCVRA experience, and that you will supervise them throughout the activity.
Health Declaration
By signing, you affirm that you (or the minor participant) are in good health and do not have any medical condition that would make it inadvisable to participate in virtual reality activities. You have not been advised by a medical professional to avoid strenuous activity or virtual reality experiences. If you are uncertain about your health in relation to VR, you agree to consult a doctor before participating.
Use of Image
You grant Mountain City VR Adventures permission to photograph or record you during the VR experience for safety, security, and operational purposes. This might include video monitoring to allow our game masters to observe the session and assist players when necessary. These photos or videos will not be used for marketing or promotional materials without your explicit written consent. We respect your privacy, and any such media is intended solely to ensure a smooth and secure VR experience.
Acknowledgment of Understanding
By signing this waiver, you acknowledge that you have read and understand all of its provisions. You understand that you are giving up certain legal rights by signing this document (including the right to sue under certain circumstances), and you sign it freely and voluntarily without any inducement or assurance of any nature. You affirm that you are signing this document with full knowledge of its significance.
